Terms & Conditions

By booking an event at All Star Party World or The 305 Club ("the Facility"), you ("the Client") agree to be bound by these Terms and Conditions as well as our Venue Policies & Requirements. Please read both documents carefully before booking your event.

Indemnification

The Client agrees to indemnify, defend, and hold harmless Line Drive Performance of Miami, LLC, its owners, officers, employees, and agents from and against any and all claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) the Client's event; (b) the acts or omissions of the Client, their guests, or any vendor engaged by the Client; or (c) any breach of these Terms or the Venue Policies by the Client or their vendors.

Limitation of Liability

The Facility is not liable for personal injury, theft, or loss of personal property during an event. Participation in all activities is at the guest's own risk. In no event shall the Facility's total liability to the Client exceed the amount paid by the Client for the event giving rise to the claim.

Liability Waivers

All guests who participate in activities at the Facility are required to sign a liability waiver. Parents or legal guardians must sign on behalf of minors. Must be filled out at the facility upon arrival. Entry may be denied to any guest who refuses to sign. We encourage you to read through the full waiver agreement before your visit so you are familiar with its contents. When you arrive, a staff member will have you sign the waiver on-site. A parent or guardian must be present to sign on behalf of all children participating in activities.

Arrival & Setup

Guests will not be permitted inside the venue until the scheduled party time or 5 minutes prior, once setup is complete. The Client is responsible for ensuring all guests adhere to this policy. Early access for setup is included only when specified in your package.

Photography & Media

By hosting an event at our Facility, you grant the Facility permission to use photographs or videos taken during your event for marketing purposes (social media, website, promotional materials), unless you explicitly opt out in writing prior to your event.

Privacy

Personal information collected during the booking process is handled in accordance with our Privacy Policy.

Force Majeure

The Facility shall not be liable for any failure or delay in performing its obligations where such failure or delay results from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, government orders, public health emergencies, labor disputes, or utility failures. In such events, the Facility will make reasonable efforts to reschedule the event on a mutually agreeable date. This clause is in addition to the specific Storm Policy detailed in our Venue Policies.

Entire Agreement

These Terms and Conditions, together with the Venue Policies & Requirements and your signed event proposal, constitute the entire agreement between the Client and the Facility with respect to the event and supersede all prior discussions, representations, or agreements.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

Governing Law

These terms are governed by the laws of the State of Florida. Any disputes arising from these terms or your event shall be resolved in Miami-Dade County, Florida.
